PRIVACY POLICY
This Privacy Policy is incorporated by reference into the BirdGenie Terms of Use. The term ” BirdGenie,” “we,” and “us” includes Princeton University Press and our affiliates and subsidiaries. “You” and “users” shall mean all visitors to or users of the BirdGenie Products (as described below).
The Privacy Policy explains how we may collect, use and disclose information we obtain through the BirdGenie Products. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY YOU MAY NOT ACCESS OR OTHERWISE USE THE BIRDGENIE PRODUCTS.
The “ BirdGenie Products” means any website, including, any mobile applications including the BirdGenie Backyard East or BirdGenie Backyard West applications, or Internet service in connection with BirdGenie whether partial or otherwise, in connection with providing an online or mobile platform.
“Personal Information” means information that can readily identify you, such as: name, address, email address, or phone number. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual. If you do not want to provide us with your Personal Information, you may still access the BirdGenie Products but certain areas or functionality may not be accessible to you.
THE BIRDGENIE PLATFORM MAY COLLECT YOUR INFORMATION
REGISTRATION, ACCOUNT & PROFILE INFORMATION
You must register to sign up for and receive the BirdGenie Newsletter. To register, you may need to provide Personal Information, such as your name, email address, and telephone number. You may also provide other optional information, such as biographical information, areas of expertise, references, and links to your social network pages.
We collect Personal Information when you:
- register to use the BirdGenie Products;
- communicate with us or send us information or materials; and/or
- make your Personal Information available while interacting with the BirdGenie Products, such as on the website forums
To take advantage of the best results of the BirdGenie Products, you will need to agree to allow the BirdGenie Products to perform certain geolocating functions. Enabling this option means that you agree to provide certain information regarding your location to BirdGenie.
We also collect non-Personal Information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the BirdGenie Products and may aggregate any information collected in a manner which does not identify any individual (“Aggregate Information”). Aggregate Information obtained in connection with the BirdGenie Products may be intermingled with and used by us in conjunction with information obtained through sources other than the BirdGenie Products, including both offline and online sources. Aggregate Information may be shared by us with third parties certain purposes, including analysis and improvement of the BirdGenie Products. The BirdGenie Products collect and store information that is generated automatically as you use it, including your preferences and anonymous usage statistics. When you visit or use the BirdGenie Products, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Most browsers allow you to block and delete cookies. However, if you do that, the BirdGenie Products may not work properly. By using the BirdGenie Products, you are authorizing us to gather, parse, and retain data related to the provision of the BirdGenie Products.
SOCIAL CONNECT
When you choose to connect your social media account to your BirdGenie Products profile, we may collect Personal Information from that social media website. For example, when you connect your LinkedIn account, we may collect the Personal Information you have made publicly available in LinkedIn in your LinkedIn profile, such as your name, photograph, headline, contact information, experience, education, summary, and location. We may also obtain other non-public information from the social network website with your permission.
CUSTOMER SUPPORT
We may collect Personal Information via your communications with our customer-support team.
HOW BIRDGENIE USES YOUR INFORMATION
INTERNAL AND SERVICE RELATED PURPOSE
The Software Product may operate continuously on your device and transmit information to PUP. You acknowledge and agree that PUP may automatically collect from your device and use statistics and other data generated based upon your use of the Software Product. Such data shall be owned by PUP and may be shared and disclosed in any manner with PUP’s affiliates, clients, suppliers, agents or assignees. We use information, including Personal Information, for internal and service-related purposes and may provide it to third parties to allow us to facilitate the BirdGenie Products. We may use and retain any data we collect to provide and improve our services.
BIRDGENIE MAY DISCLOSE YOUR INFORMATION
We may share your information:
- with our third-party service providers;
- to comply with legal obligations;
- to investigate suspected fraud, harassment or other violations of any law, rule or regulation, or the terms or policies for our services or our sponsors
- to protect and defend our rights and property; and
- otherwise with your permission.
We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.
We use vendors and service providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the BirdGenie Products, subject to appropriate confidentiality restrictions limiting their use of such information to providing services to BirdGenie.
MERGER, SALE OR OTHER ASSET TRANSFERS
If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of BirdGenie assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.
We may also disclose your Personal Information with your permission.
DISPLAYING TO OTHER USERS
The content you post to the BirdGenie Products may be displayed on the BirdGenie Products. If you choose to submit content to any public area of the BirdGenie Products, your content will be considered “public” and will not be subject to the privacy protections set forth herein or any applicable law, rule or regulation. We encourage you to exercise caution when making decisions about what information you disclose in such public areas. Furthermore, except as otherwise described in this Privacy Policy, any content you post to a public area of the BirdGenie Products may be used by us for any purpose. Other users of the BirdGenie Products may be able to see some information about you, such as your user profile. We are not responsible for the privacy practices of the other users who will view and use the posted information. Users under the age of 18 are not permitted to post or provide any information on or to the BirdGenie Products without the consent of their parent or guardian. The BirdGenie Products are available to users of all ages, please ensure that any information or content you post adheres to the “Acceptable Use” provision in the BirdGenie Products Terms of Use.
SECURITY OF YOUR INFORMATION
We take commercially reasonable steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. As a result of this and other factors beyond our control, we cannot guarantee the security of the information that you transmit to or through the BirdGenie Products. Therefore, you assume that risk by using the BirdGenie Products.
By using the BirdGenie Products or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the BirdGenie Products.
CHILDREN’S PRIVACY
We do not knowingly collect, maintain, or use Personal Information from children under 13 years of age, and no part of the BirdGenie Products is directed to children under the age of 13. If you learn that your child has provided us with Personal Information without your consent, you may alert us via our contact page. If we learn that we have collected any Personal Information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.
OTHER SITES
As a convenience to you, we may provide links to third-party sites from within the BirdGenie Products. We are not responsible for the privacy practices or content of any third-party sites. When you link away from the BirdGenie Products, you do so at your own risk.
UNITED STATES OF AMERICA
Our servers are maintained in the United States of America. By using the BirdGenie Products, you freely and specifically give us your consent to export your personal information to the USA and to store and use it in the USA as specified in this Privacy Policy. You understand that data stored in the USA may be subject to lawful requests by the courts or law enforcement authorities in the USA.
OPT-OUT PROCESS
If at any time you do not want to receive email or other communications from us in the future, please send an email to us at contact@birdgenie.com requesting to be removed from our mailing list. You will also have the option of clicking on a link included in email correspondence you receive from us in order to remove yourself from our mailing list. However, we are not responsible for removing your Personal Information from the lists of any third party who has previously been provided your information in accordance with this Privacy Policy or your consent, such as a sponsor. You should contact such third parties directly if you wish to have your Personal Information removed from their lists.
COMMUNICATIONS WITH US
By providing your email address to us, you expressly consent to receive emails from us. We may use email to communicate with you, to send information that you have requested or to send information about other products or services developed or provided by us or our business partners, provided that, we will not give your email address to another party to promote their products or services directly to you without your consent or as set forth in this policy.
Any communication or material you transmit to us by email or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, nonconfidential and nonproprietary. Furthermore, you expressly agree that we are free to use any ideas, concepts, know-how, or techniques contained in any communication you send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services using such information.
UPDATE YOUR INFORMATION AND OR POSE A QUESTION
If you would like to update or correct any information that you have provided to us through your use of the BirdGenie Products or otherwise, or if you have suggestions for improving this Privacy Policy, please send an email via birdgenie.com.
CHANGES TO OUR PRIVACY POLICY AND PRACTICES
We may revise this Privacy Policy, so review it periodically.
We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective when it is posted. If you are concerned about how your information is used, bookmark this page and read this Privacy Policy periodically.
Your continued use of the BirdGenie Products following the posting of any changes to this Privacy Policy means you accept and consent to such changes.
From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
CONTACT INFORMATION
